If you are the owner of an intellectual property right you believe it being violated (a “Brand Owner”) and believe that you have identified any fake, counterfeit, or otherwise unauthorized products being sold at the Berlin Farmers Market, we ask that you submit a Report under the BERLIN FARMERS MARKET (BFM) AUTHENTIC PRODUCTS POLICING PROGRAM (BFM-APP Program) to assist in identifying and/or stopping such activity. Please click the link below to download the report form. We ask that you provide as much detail as possible regarding the alleged violation, and ensure that you provide the appropriate contact information.

NOTE: The BFM-APP Program is for Brand Owners only. If you are a third party having no rights in the intellectual property, please do not submit a report form. Any report forms from third parties will be ignored and no action will be taken. Any third party submitting multiple forms will be fined.

Upon confirmation that the Report is valid and legitimate, Berlin Farmers Market will contact the Brand Owner in order to arrange policing the market for any violations using its on-site security and investigators at no expense to the Brand Owner. Note that on-site Brand Owner investigators are encouraged to contemporaneously contact BFM security to arrange immediate action and a higher probability of successful enforcement.

Please note that Berlin Farmers Market reserves the right to review each Report and to require additional information at its discretion. Submitting a Report will not guarantee that the alleged infringement can or will be stopped.

Each Report must indicate that the person signing the Report has a good faith belief that use of the Allegedly Infringing Material in the manner complained of is not authorized by the Brand Owner, its agent, or the law. The person signing a Report on behalf of a Brand Owner must state that the information in this Report is accurate, and under penalty of perjury, that the person is authorized to act on behalf of the Brand Owner of an exclusive right that is allegedly infringed.

Each Brand Owner submitting a Report must agree to provide information reasonably requested by Berlin Farmers Market in order to investigate the claims included in this Report. Each Brand Owner submitting a Report must agree to cooperate with Berlin Farmers Market based on Berlin Farmers Market’s reasonable request, including, but not limited to, providing training requested by Berlin Farmers Market in order to identify Allegedly Infringing Material.

Each Brand Owner submitting a Report must confirm that it recognizes that Berlin Farmers Market is not its agent in law or fact. By signing this Report, each Brand Owner agrees that it will not hold BFM or its agents liable for any violation provided in this Report.

Although Berlin Farmers Market will make every effort to have its on-site security and investigators evict violators and provide follow-up information on their identity to the Brand Owner, nothing herein or in the Report shall constitute a guarantee by Berlin Farmers Market that any identified product can or will be removed from the Berlin Farmers Market, or that Berlin Farmers Market can or will otherwise take action.

Any Report submitted by any person or business that is not a Brand Owner will be ignored and no action will be taken. Berlin Farmers Market reserves the right to impose a fine on any third parties who are not Brand Owners who submit multiple Reports.

DECLARATION

The undersigned hereby states and affirms that they have an ownership interest in, or legally represent a party having an ownership interest in, the intellectual property that is the subject of this Report (a “Brand Owner”).

The undersigned has a good faith belief that use of the Allegedly Infringing Material in the manner complained of is not authorized by the Brand Owner, its agent, or the law.

Brand Owner agrees to provide information reasonably requested by BFM in order to investigate the claims included in this Report. Brand Owner agrees to cooperate with BFM based on BFM’s reasonable request, including, but not limited to, providing training requested by BFM in order to identify Allegedly Infringing Material.

Brand Owner recognizes that BFM is not its agent in law or fact. Brand Owner recognizes that nothing herein shall require BFM to take any action. By signing this Report, Brand Owner agrees that it will not hold BFM or its agents liable for any violation provided in this Report.

Any Report submitted by any person or business that is not a Brand Owner will be ignored and no action will be taken. Berlin Farmers Market reserves the right to impose a fine on any third parties who are not Brand Owners who submit multiple Reports.
